1. Who we are#

These terms apply to your use of ServerScope (the "Service"). The Service is provided by OnHolland, trading as ServerScope ("we", "us").

2. When these terms apply#

They apply to every use of the Service and to every agreement we make with you, including the free plan. By creating an account, accepting the terms or using the Service you agree to them. If you use the Service on behalf of a company or organisation, you confirm that you are authorised to do so.

3. The Service#

ServerScope is a monitoring service. You can have servers measured by an agent, have domains and websites checked (availability, certificate, DNS, registration), manage incidents and alerts, publish status pages and retrieve your data through an API.

• We provide the Service with reasonable care and skill. This is a best-efforts obligation, not a guarantee of results.
• Measurements and alerts are an aid and can be incomplete, delayed or incorrect.
• No fixed availability (SLA) applies unless we agree one with you in writing.
• We may improve and change the Service. If a change materially affects your use, we will tell you in advance.

4. Your account and your team#

• You provide correct details and confirm your e-mail address.
• You keep your password secret. We recommend two-step verification.
• You are responsible for everything that happens under your account. Team administrators decide who is a member and with which rights.
• If you see misuse of your account, report it immediately to serverscopesupport@gmail.com.

5. Acceptable use#

You only monitor systems that are yours or that you have permission to check. You may not:

• use the Service to scan, overload or attack other people's systems;
• bypass limits, security or restrictions of the Service;
• use the Service for unlawful purposes.

The Service deliberately refuses checks of internal or private addresses. In case of misuse we may suspend or terminate your account immediately.

6. Plans and prices#

• The plans are Free, Pro and Premium. What each includes and which limits apply is shown on the pricing page and in the app.
• Prices include VAT unless stated otherwise.
• Pro and Premium only become active once payment has succeeded. Until then the Free limits apply.
• We may change prices and limits. A price increase for a running paid subscription only takes effect after at least 30 days' notice by e-mail. You can cancel before the increase takes effect.

7. Payment#

• Payments are processed by our payment provider Mollie. We never see your card or bank details.
• A paid subscription renews automatically every period (month or year) until you cancel. By paying you consent to that automatic charge.
• After each payment you receive an invoice in your account.
• If a renewal fails, you keep your subscription for 7 more days to resolve it. After that you return to Free.
• A chargeback without contacting us first is treated as a failed payment.

8. Cancelling#

• You can cancel at any time under "Plan and billing" in the app.
• Your subscription continues until the end of the period you paid for. After that you return to Free. We do not refund part of a period, unless the law requires it.
• Your data is kept. The limits and retention period of Free then apply. History older than that retention period is deleted. Whatever exceeds the limits remains, but you cannot add to it.

9. Right of withdrawal for consumers#

The Service is for businesses and organisations as well as for private individuals. If you act as a consumer, meaning not for a trade or business, you have 14 days to withdraw from a paid subscription without giving a reason. That period starts on the day you take out the subscription. If you ask us to start immediately, which you do by paying and activating the subscription, you pay for the part of the Service delivered up to the moment of withdrawal. Send your withdrawal by e-mail to serverscopesupport@gmail.com, with your name and the e-mail address of your account.

10. Your data#

Data you put into the Service or have measured remains yours. We use it to provide the Service. You make sure you are allowed to use it and to check the systems you monitor. How we handle personal data is described in the privacy statement.

11. Maintenance and outages#

We may interrupt the Service temporarily for maintenance or because of outages. For a planned interruption of significance we aim to inform you beforehand. You remain responsible for your own systems and your own backups.

12. Liability#

• We are not liable for indirect damage, such as lost revenue, business interruption or damage because an outage was not reported or reported late.
• Our total liability is limited to the amount you paid us in the 12 months before the event that caused the damage.
• These limits do not apply in case of intent or deliberate recklessness, or where the law does not allow them.
• Report damage as soon as possible. We can only respond to what we know.

13. Termination#

We may suspend or terminate your account if you breach these terms, if you do not pay or if the law requires it. After termination we delete your data, except what we are legally required to keep, such as invoices.

14. Changes to these terms#

We may change these terms. For a material change we notify you by e-mail at least 30 days in advance. If you do not agree, you can cancel before the change takes effect. When you accept, we record which version you accepted.

15. Governing law#

These terms and our agreements are governed by Dutch law. Disputes are submitted to the competent court in the Netherlands. Mandatory consumer rights remain fully applicable.
